These Terms of Use and Business Conditions (“Terms”) govern the use of montegocar.com, the submission of enquiries and bookings, and the provision of vehicle rental services by MONTEGO-CAR D.O.O., Ćazima Lekića 18, 81000 Podgorica, Montenegro (PIB 03806766).

The person submitting an enquiry, making a booking or renting a vehicle is referred to as the “Client” or “Renter”, depending on the context. The full General Terms and Conditions of rental are also available as a PDF below.

1Scope

These Terms apply to the use of montegocar.com, to bookings and to vehicle rental agreements. Additional conditions may apply to a specific rental as stated in the offer, booking confirmation, selected protection package or the rental agreement signed at pick-up.

If there is a difference between these Terms and specifically agreed conditions of an individual rental, the specifically agreed conditions prevail, except where this would conflict with mandatory law.

2MonteGo-Car services

MonteGo-Car provides short-term and, where available, long-term car rental in Montenegro. Our offer may include:

  • different vehicle categories
  • pick-up and return at agreed locations
  • vehicle delivery
  • airport delivery or collection
  • additional drivers
  • different protection packages
  • a no-deposit rental option where available
  • roadside assistance
  • cross-border use with prior approval
  • other additional services shown during booking or specifically agreed

3Information on the website

We aim to keep information about vehicles, services, prices, benefits and availability accurate and up to date. Vehicle photographs serve to present the offer.

Where a booking is not expressly tied to one specific vehicle, a vehicle of comparable or higher category may be offered when necessary due to availability, breakdown, damage or other justified reasons.

4Booking process

On montegocar.com the Client can select the vehicle, pick-up and return location, pick-up and return date and time, protection package and other available options. After entering the required details, a booking request is submitted.

A request is not a finally confirmed booking until MonteGo-Car confirms it through an available communication channel, including WhatsApp where used for confirmation. Final rental conditions may be additionally confirmed by the agreement signed at pick-up.

5Driver requirements

The driver must:

  • hold a valid driving licence of the appropriate category
  • have at least three years of driving experience
  • hold a valid ID card or passport
  • meet any additional conditions set for the specific vehicle category
  • be listed as an authorised driver
  • be able to drive the vehicle safely and lawfully

The vehicle will not be handed over to a person who does not meet the essential conditions for lawful and safe driving.

6Documents

At pick-up the Client must present valid documents required for identification and verification of the right to drive, as a rule a valid driving licence and a valid ID card or passport.

If documents are not valid, the data differs materially from the booking, or the person does not meet rental conditions, MonteGo-Car may refuse to hand over the vehicle.

7Additional driver

An additional driver may be included where that option is available and agreed. Every additional driver must meet the same essential driving requirements as the main driver. The vehicle must not be handed over to a person who is not authorised to drive under the agreement.

8Rental price

The final price is shown during booking or determined by an individual offer. The price may depend on:

  • the vehicle or category
  • rental duration
  • season
  • pick-up location
  • return location
  • protection package
  • additional services
  • special requests

Before confirming a booking, the Client must be informed of the total price or of the method of its calculation. MonteGo-Car does not charge hidden costs that were not appropriately displayed or agreed.

9Long-term rental and discounts

Where discounts for longer rental periods are displayed on the website, they apply under the conditions shown at the time of booking, and may be applied automatically for longer rentals. Promotional prices and discounts may change for future bookings. A confirmed booking keeps the price confirmed for it.

10Payment

The payment method and deadline are determined during booking, in the booking confirmation or in the agreement. The Client must pay the agreed amount in the agreed manner and time. Where payment is made through an external payment service provider, that provider's rules may also apply to the transaction.

11Security deposit

Depending on the vehicle and the selected protection package, a security deposit may be required. The exact deposit amount must be displayed or communicated for the specific booking. MonteGo-Car may also offer packages where no security deposit is required; the “no deposit” option is not automatically available for every booking, vehicle or package.

The deposit may be used to settle justified claims arising from the specific rental, in line with the agreement and applicable law. Any unused part of the deposit is refunded or released after the vehicle is checked and obligations are settled.

12Insurance and protection packages

MonteGo-Car includes vehicle insurance as part of its offer and may provide different levels of additional protection. The exact scope of cover, any Client participation in damage, exceptions and special conditions depend on the selected package and the documentation of the specific rental.

Terms such as “Full Kasko”, “Full Protection” or “zero liability” are interpreted according to the actual content of the relevant package, the insurance policy and the conditions of the specific rental. Such terms do not mean that every possible action of the driver is covered regardless of the circumstances.

13Unlimited mileage

Where unlimited mileage is stated for a specific booking, the Client may use the vehicle without a contractual limit on kilometres driven during the agreed rental period. Unlimited mileage does not change territorial restrictions, vehicle use rules or other provisions of the agreement.

14Vehicle pick-up

The vehicle is collected at the location and time stated in the booking confirmation. Depending on the arrangement, pick-up may be organised in Podgorica, at the airport, at a hotel, at another available city location, or at another specifically agreed place. Availability of a particular location is confirmed for the specific booking.

15Airport delivery and collection

MonteGo-Car may offer airport delivery and collection. Exact availability, location, time and any cost of such service are determined in the booking. If a location shown on the website is temporarily not operationally available, an available alternative will be offered where possible.

16Vehicle inspection at pick-up

Before the rental starts, the following may be recorded:

  • bodywork condition
  • existing damage
  • interior condition
  • mileage
  • fuel level
  • tyre condition
  • additional equipment
  • keys
  • documentation

Vehicle condition may be documented with photographs or a handover record. The Client should report any visible unrecorded damage before starting to drive.

17Use of the vehicle

The Renter and authorised drivers must use the vehicle carefully, responsibly and in line with its intended purpose, the agreement and traffic regulations. The vehicle must not be used:

  • for unlawful activities
  • for racing or speed testing
  • for intentionally dangerous driving
  • under the influence of alcohol, drugs or other substances affecting driving ability
  • to tow another vehicle without approval
  • off roads for which the vehicle is not intended
  • for transport contrary to regulations or the technical capabilities of the vehicle
  • by an unauthorised driver
  • in any other way exposing the vehicle to clearly unreasonable risk

18Crossing the state border

MonteGo-Car allows cross-border travel to neighbouring countries when announced and approved in advance. A Client intending to leave Montenegro must report this before travelling so that we can check whether the trip is permitted, whether insurance is valid, whether additional documentation is needed, whether territorial restrictions exist and whether an additional fee applies.

The Client must not take the vehicle into a country or area that is not permitted by the agreement, the insurance or other applicable rules.

19Fuel

The fuel return rule is determined for the specific booking and stated at pick-up. The Client must use only the correct type of fuel. If the vehicle is returned with less fuel than agreed, the justified refuelling cost may be charged in line with the rental conditions.

20Wrong fuel

If the Client fills the vehicle with the wrong type of fuel, they must not continue driving. Stop the vehicle when it is safe to do so and contact MonteGo-Car immediately. Responsibility for the resulting costs is determined according to the circumstances, the agreement and applicable law.

21Breakdown and warning lights

If a warning, breakdown, unusual noise or another problem that may affect vehicle safety occurs during the rental, the Client should stop the vehicle when it is safe to do so and contact MonteGo-Car. The Client should not arrange significant repairs without prior approval, except where urgent action is necessary for the safety of people or to prevent greater damage.

22Roadside assistance

MonteGo-Car states the availability of 24/7 roadside assistance. In case of breakdown, accident or another problem, the Client should use the contact details and instructions provided for the specific rental. Roadside assistance does not automatically mean that all costs of every event are covered if the problem arose from conduct for which the Client is responsible.

23Traffic accident

In the event of a traffic accident the Client must:

  • first protect the safety of people
  • act in accordance with traffic regulations
  • notify MonteGo-Car without undue delay
  • notify the police where required
  • collect the necessary details of other participants
  • reasonably document the event
  • follow the instructions of MonteGo-Car and the insurer

The Client must not admit liability or enter into settlements on behalf of MonteGo-Car or the insurer.

24Theft and vandalism

In the event of theft, attempted theft, break-in or vandalism, the Client must notify the police and MonteGo-Car without delay and hand over available keys, documentation and other information required to report the case and claim insurance rights.

25Vehicle damage

If new damage is identified on return, it may be documented with photographs, a record or other appropriate evidence. The Client's responsibility is determined according to:

  • the condition of the vehicle before the rental
  • the circumstances in which the damage occurred
  • the selected protection package
  • the insurance policy
  • the agreement
  • applicable law

Existing damage recorded before the rental is not attributed to the Client.

26Exclusions from protection

Certain situations may be excluded or limited by the insurance policy or the protection package, particularly where damage arises from intentional or seriously improper conduct. Exact exclusions must be determined according to the actual insurance conditions and the agreement of the specific rental. These Terms do not in themselves create additional exclusions that are not part of the applicable agreement or insurance.

27Keys, documents and equipment

The Client must carefully keep the keys, vehicle documentation, safety and additional equipment and other items handed over with the vehicle. Loss must be reported immediately.

If justified replacement or repair costs arise from the Client's conduct, reimbursement may be requested in line with the agreement and the law.

28Traffic fines, parking and tolls

The Renter is responsible for traffic offences, improper parking, tolls and other obligations arising from their use of the vehicle to the extent prescribed by law. MonteGo-Car may provide a competent authority with the data required to identify the person who used the vehicle at the relevant time.

If MonteGo-Car must pay an amount for which the Client is legally responsible, it may request reimbursement of that amount and of any justified administrative cost where such cost has been agreed in advance.

29Smoking, animals and cleanliness

Specific rules on smoking and transport of animals may be set by the agreement or by the rules of the specific vehicle. The vehicle should be returned in a condition corresponding to normal use. If extraordinary cleaning is required due to the Client's conduct, the actual justified cost may be charged where such charging is permitted and appropriately agreed.

30Vehicle return

The vehicle should be returned:

  • at the agreed place
  • at the agreed time
  • with the agreed amount of fuel
  • with the keys
  • with the documentation
  • with the additional equipment
  • in a condition corresponding to proper use during the rental

On return, mileage, fuel, equipment and vehicle condition may be recorded.

31Late return

If the Client expects a delay in returning the vehicle, they should contact MonteGo-Car as soon as possible. An extension is valid only after confirmation. Additional costs for an unapproved delay may be charged only under conditions appropriately communicated to or agreed with the Client.

32Rental extension

The Client may request an extension via WhatsApp or another available channel. An extension depends on vehicle availability and is valid only once confirmed by MonteGo-Car. An extension may change the total rental price.

33Early return

If the Client voluntarily returns the vehicle before the agreed time, any refund of the unused part of the price depends on the conditions of the specific booking. This does not affect rights that cannot be excluded under mandatory law.

34Booking changes

The Client may request a change of date, time, vehicle, location, additional driver, additional services or other booking elements. A change depends on availability, may affect the price, and is confirmed only once accepted by MonteGo-Car.

35Cancellation

Cancellation conditions are determined for the specific booking and must be available to the Client before final confirmation. Conditions may depend on the selected rate, the time remaining until the rental starts, any advance payment, a special offer and other conditions communicated in advance.

Nothing in these Terms limits consumer rights that cannot be contractually excluded under applicable law.

36No-show

If the Client does not collect the vehicle at the agreed time and does not notify MonteGo-Car, the booking may be treated as a no-show under the conditions of the specific booking.

37Refusal to hand over the vehicle

MonteGo-Car may refuse to hand over the vehicle where there is a justified reason, for example if:

  • the driver does not have the required documents
  • the driving licence is not valid
  • the driver lacks the required driving experience
  • the driver is visibly under the influence of alcohol or drugs
  • there is serious suspicion the vehicle will be used unlawfully
  • the agreed payment or deposit security has not been provided
  • another essential rental condition is not met

The consequences of refusal are determined according to the reason, the booking conditions and applicable law.

38Unavailability of the reserved vehicle

If the reserved vehicle is unavailable due to breakdown, accident, a previous renter's delay or another justified circumstance, MonteGo-Car will try to offer a vehicle of comparable or higher category. If no suitable replacement is available, another reasonable solution will be offered, including changing the booking or refunding a corresponding prepaid amount where applicable.

39Personal belongings

The Client is responsible for personal belongings left in the vehicle. If we find a forgotten item after return, we will make reasonable efforts to enable its return to the owner.

40Reviews

Users may be able to leave a review on the website. It is not permitted to publish:

  • unlawful content
  • threats
  • hate speech
  • personal data of others without an appropriate basis
  • spam
  • fake reviews
  • content with no reasonable connection to the experience of using the service

MonteGo-Car may review a submission before publication and reject content that breaches these rules.

41Client liability

The Client is responsible for their own conduct and for the conduct of persons to whom they allowed use of the vehicle, to the extent permitted by the agreement and the law. The Client may be required to compensate actual and provable damage for which they are responsible, taking into account the agreed insurance and protection package.

42MonteGo-Car liability

MonteGo-Car is responsible for its own provision of the service in accordance with the agreement and applicable law. To the maximum extent permitted by law, we are not liable for damage resulting solely from:

  • unlawful conduct of the Client
  • improper use of the vehicle
  • driving by an unauthorised person
  • inaccurate information provided by the Client
  • ignoring safety warnings
  • events outside our reasonable control

Nothing in these Terms excludes or limits liability that may not be excluded under mandatory law.

43Force majeure

We are not liable for delay or inability to perform caused by circumstances outside our reasonable control, such as natural disasters, fires, extreme weather, official prohibitions, road or border closures, serious traffic disruptions, security incidents, infrastructure outages or other comparable events. In such situations we will try to find a reasonable solution with the Client.

44Written complaints

You may send a question, claim or written complaint to monte.go.car.team@gmail.com or by post to MONTEGO-CAR D.O.O., Ćazima Lekića 18, 81000 Podgorica, Montenegro. We will respond within the time and in the manner prescribed by applicable law.

45Personal data protection

Personal data is processed in accordance with the MonteGo-Car Privacy Policy and applicable data protection law.

46Intellectual property

Texts, photographs, graphics, logos, visual identity, videos and other original website content may be protected by intellectual property rights. Without appropriate authorisation, their unauthorised copying, reproduction, adaptation, distribution, publication or commercial use is not permitted.

47Permitted use of the website

It is not permitted to:

  • use the website contrary to law
  • submit false or fraudulent bookings
  • attempt unauthorised access
  • introduce malicious code
  • interfere with the security or operation of the website
  • impersonate another person
  • misuse the review system
  • carry out unauthorised automated collection of content or data

48External services

The website may contain links to or integrations with WhatsApp, maps, social networks, payment systems and other third-party services. Independent providers apply their own terms and privacy rules.

49Website availability

We do not guarantee uninterrupted availability of the website. The site may be temporarily unavailable due to maintenance, upgrades, technical issues, security reasons or circumstances outside our control.

50Changes to these Terms

We may update these Terms from time to time due to changes in our business, services, website functionality or legal obligations. The current version is published on montegocar.com with the date of the last update. Changes do not apply retroactively to rights and obligations already arising from a confirmed booking or concluded agreement.

51Governing law

These Terms and rental agreements concluded by MONTEGO-CAR D.O.O. are governed by the law of Montenegro, except where mandatory rules applicable to the specific relationship provide otherwise.

52Dispute resolution

In case of a problem, the Client may first contact MonteGo-Car to attempt an amicable resolution. If a dispute cannot be resolved by agreement, jurisdiction is determined under applicable law. If the Client is a consumer, nothing in these Terms limits the rights or remedies available to them under mandatory law.

53Severability

If any provision of these Terms proves void, invalid or unenforceable, the remaining provisions remain in force to the maximum extent permitted by law.
