MONTEGO-CAR D.O.O., operating under the MonteGo-Car brand, respects the privacy of visitors to montegocar.com, of people who send enquiries and booking requests, of vehicle renters, additional drivers and everyone else we communicate with.

This Privacy Policy explains which personal data we may collect and process, for which purposes we use it, to whom we may disclose it, how long we keep it and which rights you have regarding your data.

2Data we may process

Depending on whether you only use the website, send an enquiry, book a vehicle or enter into a rental agreement, we may process:

  • name and surname
  • date of birth and age where needed to verify rental conditions
  • address and country of residence
  • email address
  • phone number
  • ID card or passport data
  • driving licence data
  • driving experience data
  • additional driver data
  • selected vehicle or vehicle category
  • pick-up and return location
  • pick-up and return date and time
  • additional services and protection packages
  • booking data
  • price, payment and security deposit data
  • data required to issue an invoice
  • vehicle condition data
  • mileage and fuel level
  • photographs of existing or new vehicle damage
  • data related to accidents, damage, theft or other incidents
  • data related to traffic fines, parking, tolls and other obligations arising during the rental
  • the content of enquiries and communication
  • complaint data
  • review, rating, name and location you voluntarily submit through the review feature
  • technical data about website use
  • other data reasonably required for a booking or for performance of the rental agreement

We do not collect data that is not necessary for the relevant purpose.

3Online booking

montegocar.com allows you to send a vehicle booking request. During booking we may process data on:

  • the selected vehicle
  • the pick-up location
  • the return location
  • the pick-up date and time
  • the return date and time
  • the selected protection package
  • additional services
  • the renter's personal and contact details
  • other information required to prepare the booking

Sending a request through the website does not in itself necessarily constitute a concluded contract. A booking is confirmed in line with the process shown on the website and with communication from the MonteGo-Car team.

4WhatsApp and other communication

MonteGo-Car uses WhatsApp as one of its client communication channels. Via WhatsApp we may:

  • confirm a booking
  • answer questions
  • arrange vehicle pick-up and return
  • inform you about a booking change
  • arrange additional services
  • provide assistance during the rental
  • resolve matters after the vehicle is returned

When you use WhatsApp or another communication platform, the provider of that platform may separately process certain data under its own privacy rules.

5Driving licence and identification documents

To conclude a rental agreement and hand over the vehicle we may request a valid driving licence and a valid ID card or passport. Data from those documents may be used to:

  • establish identity
  • verify the right to drive the vehicle
  • verify that rental conditions are met
  • draw up the agreement
  • protect the vehicle
  • act in the event of damage or a traffic offence
  • comply with legal obligations

We retain copies of documents only where there is an appropriate legal basis and an actual need.

6Additional drivers

If an additional driver is registered with a booking or rental, we may process their identification data, driving licence data and other data required to verify whether they meet the conditions for driving the vehicle.

A renter who provides us with another person's data should ensure that this person is aware of the submission and processing of their data.

7Vehicle pick-up and return

At pick-up and return we may record:

  • date and time
  • location
  • mileage
  • fuel level
  • vehicle condition
  • existing and new damage
  • additional equipment handed over
  • condition of keys and documentation
  • other relevant information

We may photograph the vehicle to document its actual condition before and after the rental.

8Accidents, damage and theft

If an accident, damage, theft, vandalism or another incident occurs during the rental, we may process data required to establish the circumstances and resolve the case. This may include:

  • renter and driver data
  • time and place of the event
  • description of the event
  • photographs
  • data of other participants
  • witness data
  • police documentation
  • insurance documentation
  • damage data
  • related communication

Such data is used to settle damage, communicate with the insurer, protect legal interests and comply with legal obligations.

9Traffic fines, parking and tolls

If a competent authority or another authorised entity submits a request relating to the vehicle during the rental period, we may process data required to identify the person who used the vehicle at the relevant time.

Where there is an appropriate legal basis, the required data may be provided to the police, a court or another competent authority.

10Payment and security deposit

In connection with payment we may process:

  • rental amount
  • currency
  • payment method
  • payment date
  • payment status
  • security deposit amount
  • deposit release or refund status
  • data required for accounting

If payment is made through a bank, card system or another payment service provider, that provider may process the data required to execute the transaction under its own rules. Where card data is processed directly by an independent payment service provider, MonteGo-Car does not store full card details.

11Reviews

The website may allow you to leave a review. If you voluntarily submit a review, we may process:

  • name
  • country or city, if provided
  • rating
  • review text
  • submission date

Reviews may be moderated before publication to prevent spam, unlawful content, personal data of third parties or misuse of the feature. A published review may be publicly available on the website.

14Legal bases for processing

  • the police or another competent authority
  • payment service providers
  • roadside assistance providers
  • business partners involved in performing the rental
  • other lawful sources

Where necessary and lawful, we may make data available to:

  • authorised employees and associates
  • hosting and IT service providers
  • email and communication service providers
  • booking system providers
  • banks and payment service providers
  • insurance companies
  • roadside assistance providers
  • repair shops and damage assessors
  • accounting, tax and legal advisers
  • the police

  • authorities competent for traffic offences

  • other persons where required to perform the contract or by law

We disclose data only to the extent necessary for the relevant purpose.

17International data transfers

Certain technology and communication providers may process data outside Montenegro. Where a transfer of personal data to another country requires specific conditions or additional safeguards under applicable law, data is transferred only where an appropriate legal basis and the required safeguards are in place.

20Direct marketing

We send promotional messages only where an appropriate legal basis exists. If marketing is based on your consent, you may withdraw it at any time. Unsubscribing from marketing messages does not affect communication required for an existing booking or rental.

21Retention period

We keep data only as long as necessary for the purpose for which it was collected or as required by applicable law.

Enquiries that do not result in a booking may be kept for a reasonable period required to respond and to keep a record of the communication.

Data related to a booking and rental agreement is kept for the period required for performance of the contract, business records and protection of legal interests.

Accounting and tax documentation is kept for the periods prescribed by law.

Documentation related to damage, accidents, theft, traffic fines, complaints or disputes may be kept until the case is closed and the relevant periods for establishing or defending legal claims have expired.

We apply reasonable technical and organisational measures to protect data against:

  • unauthorised disclosure

No information system can guarantee absolute security.

23Your rights

In accordance with applicable law and subject to legal conditions, you may have the right to:

26Data of minors

The vehicle rental service is not intended for minors as renters or drivers. We do not knowingly collect data of minors except where there is a specific lawful need.

27Automated decision-making

Through our own website we do not make decisions producing legal or similarly significant effects for the user solely by automated processing, unless such processing is lawful and the user has been appropriately informed in advance.

28Sale of data

We do not sell personal data.

29Changes to this Privacy Policy

We may update this Policy from time to time due to changes in our business, website functionality, technology or legal obligations. The current version is published on montegocar.com together with the date of the last update.
